Please read these Terms of Service ("Terms") carefully before using the PelviZen LLC website, app, or discovery algorithm. By accessing or using our services, you agree to be bound by these Terms and our End-User License Agreement (EULA).

1. Description of Services

   PelviZen LLC provides a digital platform including:

   • Discovery Algorithm: A tool designed to provide personalized pelvic health education and suggestions.
   • Premium Subscription: A paid, recurring membership providing access to exclusive clinical data, comparative analysis of medical devices, and advanced educational content.
   • Telehealth Facilitation: Formal medical consultations facilitated via a third-party Electronic Medical Record (EMR) provider, Tebra Health.

   PelviZen LLC reserves the right to modify, suspend or discontinue any part of the Services at any time without notice. PelviZen LLC shall not be liable for any modification, price change, suspension or discontinuance of the Services.

2. Medical Disclaimer & Professional Relationship

   PelviZen LLC is an educational platform.

   • No Doctor-Patient Relationship: Use of this service does not create a doctor-patient relationship.
   • Information, Not Advice: Content is for informational and educational purposes only and is not a substitute for professional medical advice, including diagnosis, treatment, cure or prevention of any medical condition.
   • Clinical Validation: Final clinical diagnoses are only established during a direct consultation via Tebra Health.

   PelviZen LLC does not guarantee the accuracy, completeness or timeliness of any educational content or algorithmic output. You agree that reliance on any information provided by the platform is solely at your own risk.

3. Premium Subscriptions & Billing

   • Billing via Stripe: Payments are processed securely through Stripe.
   • Automatic Renewal: Subscriptions renew automatically unless canceled.
   • Cancellation Policy: Cancel anytime via account settings; no prorated refunds are offered.
   • Access Limits: Premium access is for a single user only.

   PelviZen LLC may change subscription pricing at any time, with changes taking effect at the next billing cycle. PelviZen LLC may terminate or suspend your subscription for any violation of these Terms without a refund.

4. Not a Medical Emergency Service

   IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY. Our services are not monitored 24/7. You acknowledge that PelviZen LLC does not monitor communications or user activity in real time and has no obligation to respond to urgent messages.

5. Third-Party Providers

   We utilize Tebra Health (EMR) and Stripe (Payments). PelviZen is not responsible for the acts, omissions, availability, security, policies, content or privacy practices of any third-party provider, including Tebra Health and Stripe.

6. User Responsibilities & Zero Tolerance Policy

   You represent and warrant that you are at least 18 years of age and all information provided is accurate.

   Zero Tolerance for Objectionable Content: PelviZen LLC maintains a zero-tolerance policy regarding objectionable content and abusive users. You agree not to use the service to:

   • Post, upload, or transmit any content that is defamatory, obscene, pornographic, offensive, or promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.
   • Engage in abusive, harassing, or threatening behavior toward other users or PelviZen staff.

   Consequences: Any user found violating these standards will have their access terminated immediately and permanently without a refund.

   You agree to comply with all applicable federal, state, and local laws, including those related to telehealth, data privacy and medical information.

   You agree not to use the Services for competitive analysis, reverse engineering or to develop competing products.

   You are solely responsible for the accuracy of all information you provide. PelviZen LLC is not liable for any harm resulting from inaccurate, incomplete or misleading information submitted by you.

7. Intellectual Property

   The algorithm, website design, logo, and proprietary content are the exclusive property of PelviZen LLC. Reverse-engineering, scraping, or unauthorized distribution is strictly prohibited.

   You may not use any content, data or output from the Services to train machine learning models, artificial intelligence systems, or similar technologies. Any unauthorized use of the Services may result in immediate termination of Services and legal action.

8. Limitation of Liability

   To the maximum extent permitted by law, PelviZen LLC, its officers, employees, contractors and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages, including but not limited to loss of data, loss of profits, personal injury or wrongful death.

   In no event shall PelviZen LLC's liability exceed the amount you paid to PelviZen LLC in the twelve (12) months preceding the event giving rise to the claim.

   You acknowledge that the Services are provided "as is" and "as available" without warranties of any kind.

9. Indemnification

   You agree to indemnify, defend and hold harmless PelviZen LLC from any claims, damages, liabilities and expenses arising out of your use of the Services, your violation of these Terms or your violation of any law or third-party rights.

10. Disclaimer of Warranties

    All content and services are provided without warranties of any kind, express or implied.

11. Governing Law

    These Terms are governed by the laws of the State of Oregon.

    Any dispute arising out of or relating to these Terms shall be resolved exclusively through binding arbitration in the State of Oregon. You waive any right to participate in a class action or class-wide arbitration.

12. End-User License Agreement (EULA)

    By downloading or using the PelviZen App, you acknowledge and agree to the following:

    • Acknowledgement: This agreement is between you and PelviZen LLC only, not Apple, Inc. PelviZen LLC is solely responsible for the app and its content.
    • Scope of License: You are granted a non-transferable, non-sublicensable license to use the app on any Apple-branded products that you own or control.
    • Maintenance & Support: PelviZen LLC is solely responsible for providing maintenance and support. Apple has no obligation to furnish any maintenance or support services.
    • Reporting & Moderation: You may report any objectionable content or abusive users on the app or directly to customerservice@mypelvizen.com. We commit to reviewing and acting upon such reports within 24 hours.

    PelviZen LLC may revoke this license at any time for violation of these Terms.

    Users are prohibited from attempting to access or modify the app's source code, algorithms or backend systems.

13. Termination

    PelviZen LLC may terminate or suspend your access at any time, with or without cause.

14. Severability

    If any provision is found unenforceable, the remainder of the Terms remain in effect.

15. Entire Agreement

    These Terms constitute the entire agreement between you and PelviZen LLC.
